These ‘Terms and Conditions’ regulate the use of this website (‘site’) and we recommend that you read them before continuing this visit/analysis.

1. General Information
The Owner of the website is L.C.S.D – Associação Data CoLAB – Laboratório Colaborativo para Serviços de Inovação Orientados para os Dados, NIPC 516 540 068, with registered offices at Avenida de Cabo Verde, Lote 1, 4900-568 Viana do Castelo, hereinafter also referred to as Data CoLAB.
Throughout the website, the terms ‘we’, ‘us’, “our” and ‘Owner’ refer to the aforementioned organisation (Data CoLAB).
2. Acceptance of these “Terms and Conditions”
2.1 The Owner provides the User with the website and all its available information, tools and services, subject to full acceptance of these ‘Terms and Conditions’, as well as all the Policies and notices contained therein.
2.2 By accessing any part of the website you are using our ‘Services’ and therefore accept these ‘Terms and Conditions’ as well as the Policies, which apply to all Users. Otherwise, you should not continue to use the website or any services arising from it.
2.3 The ‘Terms and Conditions’ and the Privacy Policy constitute a contract between the User and the Owner and apply, as stated above, to the use of the website.
2.4 As a User, you can read all the Policies at any time by using the link at the bottom of the website.
2.5. This website is offered and controlled by the Owner Entity, better identified in item 1 above, from its premises located in Portugal. Anyone accessing or using these services from other countries does so at their own risk and is therefore solely responsible for complying with the applicable legislation.
3. Your behaviour
3.1. Users must use this website responsibly and must always act in good faith.
3.2 The User undertakes to:
- Not to adopt conduct contrary to the law, such as those that constitute violations of the rights of others and offences against the good name, image, reputation and prestige of any persons, whether individuals or companies, namely Data CoLAB and other users;
- Not to design and not use any technological tools or measures, whether through computer programming or the use of pre-existing software, intended or capable of interrupting, destroying, limiting the functionality or exploiting any computer vulnerability of the website, any equipment or computer system;
- Not jeopardise the continuity, integrity and quality of the content and functionalities made available, nor interfere with the rights and/or abilities of other Users to access this website;
- In the event of detecting any defect, error or anomaly in the website, the User undertakes to immediately notify Data CoLAB of its existence and not to seek to access commercial information, personal data of other users, alter the characteristics of the website or, in any other way, exploit the defect, error or anomaly to use the website in an irregular, unlawful or different manner to that designed by Data CoLAB.
3.3. Any breach by the User of the obligations set out in this Clause may result in the User being held liable under the law for any damage caused to Data CoLAB and/or third parties.
4. Prohibitions
4.1 It is expressly forbidden to use this website for the purpose of making available or sharing illegal content.
4.2. The User may not use this website or its contents if such use is carried out for purposes and/or conditions other than those permitted in these ‘Terms and Conditions’.
4.3 The publication on this website of any information or content belonging to third parties, or over which the User does not hold the respective intellectual property rights (such as content protected by copyright, industrial property) or content containing Personal Data of third parties is not permitted.
4.4 It is expressly forbidden to use the website to provide or download any type of material, files or programmes that could interrupt, destroy or limit the functionality of the website or any equipment.
4.5 The knowing introduction of any viruses, Trojans, worms or other malicious software that is detrimental to the provision of services is prohibited on this website.
4.6 Unauthorised access to the website, the server on which the website is stored or any server, computer or database connected to the website is prohibited.
4.7 Any practice on the part of the User which renders the website inaccessible or inoperative is prohibited.
4.8 The use, reproduction, display or publication without permission of the logos/brands available on the website, as well as those of third parties, is hereby prohibited.
4.9. Violation of the provisions of this clause constitutes a legally punishable offence and will cause various damages to the Owner. The User hereby undertakes to indemnify the Owner for any direct and indirect damages that the latter may suffer or incur as a result of a breach of the provisions of these ‘Terms and Conditions’, specifically this clause.
5. External websites
5.1. These ‘Terms and Conditions’ apply only to the use of this website and therefore do not apply to any external sites whose links may be made available together with our content/information. Such links only serve to facilitate access to additional information and for the convenience of the User.
5.2 The inclusion on the website of content provided by third parties and hyperlinks does not imply acceptance by the Owner of the content on those sites or any association with their owners. Nor does it mean that the Owner has any rights over the content made available on these sites.
5.3 The Owner cannot be held responsible for any errors, outdated information, losses or damages that may result from accessing and/or using external sites or applications, since, as stated above, it has no control over them.
5.4 Users and/or third parties are solely responsible for accessing and using any websites administered by third parties. We recommend that, before analysing these sites, you read their respective Terms and Conditions, as well as all the Policies and Notices contained therein.
6. Intellectual Property
6.1 The User recognises that the website and its contents are the property of the Owner, or that the respective rights have been previously and duly licensed or assigned to Data CoLAB. The user also recognises that this website may contain images or other material whose copyright or intellectual property rights belong to third parties, such as suppliers or other entities that contribute to its creation or maintenance (for example, photos from image banks).
6.2 This website and its contents are protected by Intellectual Property Rights (Copyright, Industrial Property Rights and other related rights), personality rights (such as image rights) and the respective applicable legislation, and the User is obliged to respect them.
6.3 The User is not authorised to transmit, publish, modify, copy, sell, use or distribute in any way the texts, images or other information contained on this website without the prior written authorisation of Data CoLAB.
6.4 Nothing on this website shall be construed as granting any kind of licence or other authorisation of use/property to its Users.
6.5. The User may not remove, hide or alter any notices of Copyright or other Intellectual Property Rights that are displayed on this website.
6.6 The User is responsible for misuse of the website and for any breach of these Terms and Conditions.
7. Updating Content
7.1 The information provided on this website is essentially intended to clarify and inform Users about Data CoLAB’s activity. This information is therefore purely indicative and may contain errors or inaccuracies.
7.2 The Owner will use its best endeavours – but is under no legal obligation to do so – to make up-to-date information (with the date of the latest version) available on this website.
7.3 The most recent versions of the content made available replace all previous versions.
7.4 The User is responsible for checking the date of the content. The Owner is not responsible for the use of outdated content by the User.
7.5 The Owner disclaims any liability for any direct, indirect and/or incidental damages arising from the use or inability to use the materials contained on this website and does not control and is not responsible for any illegal, offensive or defamatory conduct of its Users.
8. Availability of access
8.1. Data CoLAB reserves the right to interrupt or suspend access to the website, without prior notice, for as long as it deems necessary, for any technical, administrative, force majeure or other reasons.
8.2 The Owner also reserves the right to update, correct, suspend, withdraw, discontinue or change all or part of our website and/or its content at any time and without prior notice. Nevertheless, Data CoLAB will avoid any lasting interruptions of access to the website, for example for repairs, maintenance or updates.
8.3 The Owner shall not be held liable for any suspension or interruption of access to the website.
9. Forms
9.1 When filling in the forms on this website, particularly for subscribing to our newsletter, the user must answer truthfully and completely, providing all the information requested.
9.2 Data CoLAB is not responsible for the content that may be provided in the forms, nor for any damage that may arise as a result of incorrect information provided by the User.
9.3 When filling in the forms, the User must refrain from entering the Personal Data of third parties who have not been duly informed of the terms of the processing of Personal Data and/or who have not given their consent for this purpose, in accordance with our Privacy/Protection of Personal Data Policy.
10. Personal Data
10.1 The Privacy and Personal Data Protection Policy available at https://datacolab.pt/privacy-policy/ is intended to inform Users of the general rules governing the processing of their Personal Data.
10.2 Your Personal Data is collected and processed in strict compliance with the applicable Personal Data Protection legislation in force, namely Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (also known as the ‘GDPR’) and Law no. 58/2019 of 08 August.
11. Indemnity
11.1 In the event of a breach of the provisions of these Terms and Conditions, of any law or of the rights of a third party, the User agrees to indemnify, defend and hold harmless the Owner for all damages suffered or to be suffered as a result of such act/s.
12. Applicable law and jurisdiction
12.1 In the event of any omission in these ‘Terms and Conditions’ or in the event of any difficulty in interpretation, the provisions of Portuguese law shall apply.
12.2 Any conflict arising under these ‘Terms and Conditions’ shall preferably be resolved amicably between the Parties.
12.3 In the event that the provisions of the preceding item are not possible, and without prejudice to any mandatory provisions of the law, for any issues arising from these ‘Terms and Conditions’ the jurisdiction of the District corresponding to the registered office of the Owner Entity is established, with express waiver of any other.
13. Survival
13.1 If a clause/provision of these ‘Terms and Conditions’ is found to be illegal, void or ineffective, it shall be deleted.
13.2 The determination of illegality, nullity or ineffectiveness of a clause shall not prejudice the validity and enforceability of any other provisions contained in these ‘Terms and Conditions’.
14. Changes to these ‘Terms and Conditions’
14.1 We reserve the right to update or amend these ‘Terms and Conditions’ whenever necessary.
14.2 It is the User’s responsibility to read and review the ‘Terms and Conditions of Use’ each time they access the website, to be aware of any changes made, as they affect their rights.
14.3 If you do not accept the new version of the ‘Terms and Conditions’, you may no longer access and use the website.
14.4 The latest version of the ‘Terms and Conditions of Use’ replaces all previous versions.
